XV International School of Young Legal Scholars. Round table “Main trends of amendments and additions to the modern constitutions of foreign states”

On June 5, 2020 a round table "Main trends of amendments and additions to the modern constitutions of foreign states" was held within the framework of the XV International School of Young Legal Scholars.    

The round table was opened by moderators, Y. N. Kashevarova – the head of Educational Center, PhD in law,  F. A. Leshenkov – researcher at the Department of foreign constitutional, administrative, criminal law and international law, senior lecturer, I. A. Shulyatev – senior lecturer at the Department of International and European law, PhD in law, E. K. Sayfullin – chairman of the Student Council, the first category specialist at the Department of International and European law.    

O. I. Benditskaya, executive director of the Center for International Legal Education, held a presentation of the Swiss Academy for International Law to the participants of the round table. 

V.Yu. Artemov, senior researcher at the Department of foreign constitutional, administrative, criminal law and international law, PhD in law, dedicated his speech to the constitutional reform, which was carried out in Malaysia in 1993 and was aimed at limiting the monarchy and the judicial immunity of the monarchs – rulers of the states (Malaysia, like the UAE, is a federative monarchy, which in its own turn is composed of several monarchies). As a result of the reform there was established the Special Court of Malaysia to whose jurisdiction all the rulers and members of their families shall be subject.

The report of Yu. P. Michurina, post-graduate student of the ILCL, on topic of «Some points of value traditions and constitutional modernization in the modern world» considered issues related to the reasons for constitutional changes, some examples of mass modernization of constitutions in different countries. The report also reveals social norms as example of main trends of changes in the Constitution.

D. A. Strenin, 2nd year student of the Law faculty of the Financial University under the Government of the Russian Federation and M. A. Tarasova, 1st year student of International Finance faculty of the Financial University under the Government of the Russian Federation spoke about the development of technology and the Swiss Constitution. The tendency in the development of constitutional legislation in the Swiss Confederation is to adopt the achievements of modern science and establish the principles of implementation, as well as set the limitations.  The process of amending the Constitution of Armenia was discussed in the speech of D. B. Veliulova post-graduate student of the ILCL. The need to improve the efficiency of governance and to ensure balance in the system of state power contributed to the introduction of amendments. As a result, the state's form of government was changed.    

Main issues of digital governance in Germany were the subject of consideration by F. A. Leschenkov researcher at the Department of foreign constitutional, administrative, criminal law and international law. Data protection and public management found reflection in the Basic Law of Germany.

Within the round table the following issues were discussed: factors that affect the dynamics of constitutional changes; whether the constitution changes the life of society or it is a reflection of natural changes; what affects the dynamics of constitutional changes in foreign countries and what it depends on; how the implementation of the changes is made and what processes it is accompanied by; the role of citizens in the processes of constitutional changes, etc. A.V. Petryakova a retired judge, senior lecturer at the Moscow University of Finance and law, N. V. Kichigin the acting head of the Department of environmental and agricultural legislation, leading researcher, PhD in law actively participated in the final discussion.
